Electric Bike Rental Agreement
and Handover Checklist
Rental provider: Lemone Tree Development d.o.o., Brsečinska 2, 20000 Dubrovnik, Croatia, OIB 11852890547 (E-Bike Point).
This agreement sets out the main terms for renting an E-Bike Point electric bicycle. The renter completes and signs the handover checklist at pickup.
1. Renter and eligibility
The person signing the rental agreement must be at least 18 years old and show a valid identity document for an identity check. ID details are not copied or retained. The renter may ride the bike only if they can safely operate its size (M; minimum rider height 120 cm). A small child may be carried only in a suitable, approved child seat with a child’s helmet. Children’s e-bikes are not available.
2. Handover and bike condition
The bike is handed over with the equipment listed in the rental record after a joint inspection. By signing the handover record, the renter confirms that they inspected and received the bike in working, roadworthy condition, except for any defects expressly recorded at pickup. The record should include the bike identifier, accessories, battery level and any existing damage. Do not mark an item as satisfactory if it was not checked or there is a concern; ask for an inspection before setting off.
Return the bike with its accessories to the agreed place and by the agreed time. Usual collection is 9:00 AM–1:00 PM and return is 6:00 PM–9:00 PM, unless a different time is expressly recorded in the agreement or booking.
3. Safe use and incidents
The renter must use the bike carefully, for its intended purpose and in accordance with traffic laws, and wear the supplied helmet while riding. Do not ride under the influence of alcohol or drugs; lend the bike to an unauthorised person; carry a passenger except in an approved child seat; exceed load limits; alter or repair the bike without prior agreement; or leave it unlocked. Keep the key and lock safely, and separately from the bike where possible.
After a fall, collision, breakdown or other damage, stop riding if it is unsafe to continue, contact E-Bike Point immediately and follow its instructions. In case of injury, call 112. For a road accident or damage to a third party, follow the law and notify the authorities when required. Do not authorise repairs at the company’s expense without prior approval, except urgent steps needed for immediate safety.
4. Breakdowns, falls, damage and financial responsibility
A fall or breakdown alone does not automatically make the renter liable. The renter is fully or partly responsible, and must pay documented costs, only where the damage was caused by the renter’s intent, negligence, breach of this agreement or improper use, including the actions of anyone the renter allowed to ride. The renter is not responsible for normal wear, deterioration, a hidden or pre-existing defect, or damage for which the renter is not at fault.
For typical minor damage caused by an act for which the renter is responsible, the contribution towards repair is up to €20 for a puncture or paint scratch and up to €30 for a chain or gear repair, based on actual, verifiable cost. Other repairable damage may be charged at the actual documented repair cost. For total damage or loss of a bike or accessory, the provider may claim the documented replacement value of an equivalent item, reduced by reasonable depreciation for its age and condition. The same loss will not be charged twice; the renter will receive a description of the damage and an itemised calculation.
If the bike develops a fault without the renter’s fault, the renter must notify the provider immediately and stop riding if it is unsafe. Depending on the circumstances and availability, the provider will arrange assistance, a replacement or a proportionate price reduction. Nothing in these terms excludes liability that cannot lawfully be excluded.
5. Return, late return and missing bike
Any late return must be agreed in advance by phone or message. If the bike is not returned during the agreed business hours and the delay has not been approved, the rental will be charged for one additional day at the applicable daily rate. If the renter has not contacted the provider within 24 hours after the agreed return time, the provider may report the bike as missing to the police and provide available information. Any loss claim will be assessed under section 4 and the actual circumstances.
6. Payment, cancellation and bad weather
Advance bookings are paid by card through the app. A rental arranged for the same day is paid in cash at the location. Cancellation at least 7 calendar days before the rental date qualifies for a refund to the same card within a few business days. Cancellation within 7 days or a no-show is charged at the full booking amount. If rain or severe weather makes riding unsafe, the guest may arrange a new date or use the amount paid at Bistro Bacchus. These terms apply subject to mandatory consumer rights under applicable law.
7. Personal data, complaints and final terms
To provide the rental, the company processes the renter’s full name, phone number, rental date, signature and bike or booking details. Identity is checked by viewing an ID document; no copy or ID number is stored. The rental agreement is kept for one month, except for records that must be retained longer by law, such as accounting documents. This agreement is not consent to take or use promotional photographs; separate consent is required.
If a booking was made through an online platform or other intermediary, this agreement governs the bike rental between the company and the renter. The platform or intermediary is responsible for its own services and obligations to the extent provided by its terms and applicable law. This agreement does not transfer one party’s responsibility to another or exclude liability that cannot lawfully be excluded.
A written complaint may be sent to the company at Brsečinska 2, 20000 Dubrovnik, Croatia, or through the contact details in the booking confirmation. The company will respond to a consumer’s written complaint within the statutory time limit. Croatian law applies. Jurisdiction is determined under applicable law.
Renter acknowledgement
By signing the rental and handover record, the renter confirms that they have read and accepted these terms; inspected the bike and equipment and had any pre-existing damage recorded; will report any breakdown, fall or accident immediately; and will pay only for damage for which they are responsible under this agreement and the law.
