Please read this document carefully. This document contains the Privacy Policy for users of “BinBin” d.o.o., users of their website https://www.binbin.tech/index_en.html and users of the BINBIN Scooters mobile application (hereinafter referred to as “Policy”). Its purpose is to explain our operations related to the processing of personal data in the context of the services we provide and the activities we perform. This Policy has been prepared in accordance with the requirements of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive 95/46/EC (General Data Protection Regulation).
General Provisions
In connection with the provision of our services and the conduct of our activities, “BinBin” d.o.o. (“BINBIN” / “we”), as the data controller, processes personal data of its users—natural persons—as well as personal data of other individuals mentioned below (“Data Subjects” / “you”), in accordance with the rules and principles set forth in this Policy.

Data Subjects
In connection with the provided services, we process information about the following Data Subjects: (a) individuals who visit or register via the website https://www.binbin.tech/index_en.html or the BinBin Scooters app (hereinafter collectively referred to as “Applications”); (b) individuals who make purchases through the applications, on their behalf or on behalf of another natural or legal person (if possible and permitted under our User Agreement); (c) individuals who use the services we provide, including the rental of electric scooters in accordance with our general terms in the User Agreement and related services, including individuals who represent or act on behalf of legal entities using said services; (d) individuals who have, on their behalf or on behalf of another person, sent inquiries (including, but not limited to, via email, fax, phone, or otherwise), requests, complaints, grievances, or other correspondence to BINBIN.

Log information: login logs (if applicable), server logs, application firewall logs, and other devices in this category: date and time, IP address, URL, browser and device information;

Data relating to payments and invoicing
Information about payment methods (credit card, etc.); information on due and completed payments; data on payment due dates and overdue/unsettled debts; banking information (credit card); currency of payment; number, expiration date, and cardholder of the credit/debit card; CVC code; data contained on payment slips; authorization slips (signed).
In cases where the data subject represents another person (e.g., a company): data about the represented person and the representative’s status (including job title, position), as well as data on the ordered services/submitted orders in that capacity. In cases where services are ordered by someone who is not the data subject on behalf of the data subject—specifying how the data subject will use the services, who ordered the services, who will make the payment, etc. (e.g., in cases of accommodation organized by the subject’s employer or business partner, etc.).

LEGAL OBLIGATIONS
Surveillance and Security
- We may apply security measures including a 24-hour video surveillance system for recording and storing data to ensure physical security against breaches in buildings and construction sites, as well as to protect the lives and health of citizens.
- Video surveillance and recording may occur in publicly accessible zones and areas within BINBIN’s buildings and in zones and areas with exclusive access control systems. If unavoidable, video surveillance may capture part of the street in front of BINBIN’s premises, exclusively for the protection of personal property. There is no video surveillance in restrooms, recreational rooms, etc. Data on video surveillance activities are stored in a special locked room with restricted access. Records are reviewed only after an incident (such as a damaging event, illegal action by an employee, client, or third party), as the relevant part of the recording will be archived and stored for the necessary period to exercise our rights.
- Informational boards are available in visible places to inform data subjects and other visitors that technical means for surveillance and control are being used, providing all other related information.
Direct Marketing and Statistical Data
- Binbin d.o.o., or other companies related to us or our partners, may process the following personal data: names; phone number; address; email address; information about the type and number of services used and selected that we provide and other data explicitly stated in the additional consent for direct marketing purposes, such as offers of goods and services, including goods and/or services offered by other parties, conducting inquiries and surveys to improve the quality of provided services, etc., within the framework of the appropriate consent.
- If personal data is processed for direct marketing purposes, you have the right to object to such processing at any time or withdraw your consent for processing. In such cases, the processing of personal data for such purposes will cease.
- Providing transportation solutions necessitates data sharing with educational institutions, municipalities, and NGOs regarding measures for green efficiency. Data that may be provided includes: (a) Usage information – daily, monthly, yearly; (b) Total distance traveled; (c) GPS coverage of scooters; (d) Reduced travel time; (e) Reduced CO emissions;
Purpose of Processing Personal Data
- The information described above is collected, stored, and processed for the purposes outlined in this Policy, which, depending on the legal basis for processing, may include: (a) purposes related to compliance with BINBIN’s legal obligations; (b) purposes necessary for the performance of contracts entered into with us or to take steps at the request of the data subject prior to entering into a contract; (c) purposes related to our legitimate interests or those of third parties; (d) purposes for which the data subject has given consent for processing their data.
Provision of Personal Data and Consequences of Refusal
- We clearly indicate, where applicable and in an appropriate manner, whether the provision of relevant data and/or documents is mandatory or a condition necessary for the conclusion or performance of a contract, as well as the consequences of refusing to provide such data. Any refusal to provide data and documents marked as mandatory may hinder our ability to provide our service to meet and fulfill submitted requests, signals, etc., which relieves us of liability for non-performance.
Other Sources of Personal Data
- In certain cases, personal data that we process is not collected and received directly from the relevant data subjects but from third parties, such as: (a) individuals representing, working for, or otherwise collaborating with the data subject; (b) event organizers—concerning information about event participants; (c) business partners (e.g., websites; agencies, other persons providing intermediary services in the context of ordering other services, etc.) of BINBIN; (d) competent state and judicial authorities.
Categories of Recipients of Personal Data. Data Storage
- We do not disclose personal data of the data subject to third parties unless: (a) it is necessary to comply with our legal obligations—such as competent state, municipal, or judicial bodies, auditors; (b) it is explicitly provided for in the Privacy Policy and/or general terms (contract) for using our services—such as data processors we have appointed, debt collection companies; (c) it is necessary to provide our services—such as banks and payment service providers, postal and delivery service providers, our business partners such as websites; agencies and other vendors or other support services; (d) the data subject has given their explicit consent to share their personal data with third parties.
- Personal data will be stored in accordance with applicable regulations and for a period that is necessary to achieve the purposes for which we processed it, while the maximum retention period for personal data will not exceed 10 years.
Security of Personal Data
- We implement appropriate technical and organizational measures to ensure the integrity, confidentiality, and availability of your personal data and protect it from loss, unauthorized access, misuse, or destruction, including: (a) access controls to relevant premises and systems; (b) physical security measures; (c) information security measures; (d) data protection training for our employees and other staff.
Rights of Data Subjects
- In relation to their personal data, Data Subjects have the following rights: (a) the right to access their personal data; (b) the right to rectify their personal data; (c) the right to erasure of their personal data (the right to be forgotten); (d) the right to restrict processing; (e) the right to data portability; (f) the right to withdraw consent for processing at any time if the legal basis for processing is consent.

- We will respond to your request without undue delay, and at the latest within one month from the receipt of your request.
Changes to the Privacy Policy
- We may periodically update or amend this Privacy Policy to reflect changes in our practices or relevant legislation. If significant changes are made, we will notify you by placing a notice on our website and/or in the BinBin Scooters app.
- This Privacy Policy is effective from October 25, 2023.
The right to submit a complaint to a supervisory authority - Every data subject has the right to lodge a complaint with the body for personal data supervision. The supervisory body in the Republic of Croatia is: PERSONAL DATA PROTECTION AGENCY, Selska cesta 136, 10000 Zagreb Clarifications and additional information.
- The data subject can request clarifications regarding the content, reasons and method of exercising their rights from this Policy, as well as any additional information about their rights in connection with the processing of personal data by BINBIN at the contact information specified in point 2 above. . This Privacy Policy was created by BINBIN in the capacity of data processing manager in order to fulfill its obligations to provide information to respondents under Art. 13 and Art. 14. Regulation (EC) 2016/679 of the European Parliament and the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation ). We reserve the right to update and amend this Privacy Policy from time to time to reflect any changes in the way we process your personal data or changes to your legal requirements. In the event of such changes, we will post the amended version of the Privacy Policy on our website and therefore please review its content periodically. This Privacy Policy enters into force on August 8, 2022. year.
